F.S. man arrested after crash with police car

Police say driver was drinking, had marijuana

A Franklin Square man was arrested in Franklin Square for drunken driving and crashing into a marked police car on Sept. 22 at 5:30 a.m., police said.

According to the 4th Precinct, Jose Martinez, 22, of Phoebe Street, crashed into a police car after the officer had taken a 40-year old man into custody for driving with a suspended license. Police say that the officer at the scene, who had arrested the man who was driving illegally and placed him in the back seat of the police car, was in the driver’s seat of the car when it was struck by a 2001 Hyundai operated by Martinez.

Upon investigation, the officer found that Martinez was under the influence of alcohol and found two bags of what police belied to be marijuana and drug paraphernalia in the center console of the car. The Hyundai was impounded and the officer and 40-year old man were taken to a hospital, where they were treated and released. The man was taken to the 4th Precinct, where his arrest was completed.

Martinez is charged with second-degree reckless endangerment, two counts of driving while intoxicated, aggravated driving while intoxicated, unlawful possession of marijuana and several violations of the Vehicle and Traffic Law.

He was arraigned at Sept. 23 at First District Court, in Hempstead.
