More violations at Magnolia Day Care

State says it failed to report suspected child abuse or maltreatment

The Magnolia Child Care Center was slapped with nine violations by the state last month, including two for failing to report alleged child abuse or maltreatment.

According to the New York State Office of Children and Family Services, the center, at 650 Magnolia Blvd., was hit with the violations in March during an inspection by the agency.

The Child Care Center, which serves 49 children, is one of two child care programs in the city, and is run by the Department of Youth and Family Services. It offers programs licensed by the county and state, and, as of last September, it employed 14 day care workers, a director and two kitchen workers, as well as administrative, clerical and maintenance staff.

According to one of the violations issued on March 25, in accordance with the provisions of Social Services law, the center’s “staff must report, or cause a report, to be made of any suspected incidents of child abuse or maltreatment concerning a child in care to the Statewide Central Register of Child Abuse and Maltreatment.” OCFS said that the center had failed to do so.

Additionally, the agency said, “if the director of the center is the person allegedly responsible for the alleged abuse or maltreatment of the child in care, staff must report the alleged abuse or maltreatment directly to the SCR.”

OCFS, the agency responsible for licensing such facilities, did not offer details of the violations or any incidents of alleged child abuse. A spokeswoman for the agency, Jennifer Givner, said only that the investigation of the center was continuing.

Of the nine violations issued in March, three have been corrected, the agency said, including one for the improper use of a “firm, sanitary crib, cot, bed or washable padded mat” for children during rest period, and another for inadequate sleep, rest and quiet periods.
