Kassof is a dog lover and rescued this dog and two others from the Town of Hempstead Animal Shelter, Rattoballi said. “He’s distraught over the loss,” he said.

According to Rattoballi, Kassof had no other choice but to leave the dog in his car. Kassof usually left the dog with his parents, but they had a prior commitment. Another option was a shed outside of National Grid, where Kassof works, but that was occupied.

Rattoballi said that Kassof left all windows open 3-5 inches, contradicting the report from the Nassau County District Attorney and while walking the dog in the afternoon, Kassof also gave the dog a bowl of water.

“He had no intention of harming the dog,” he said.

Kassof is due back in court on July 24 and was released on his own recognizance.
