Lynbrook board votes in favor of rezoning, sub-dividing

After much deliberation, presentation from council and input from residents, the Lynbrook Board of Trustees voted unanimously, 5-0, in favor of the rezoning and sub-division of two properties on Merrick Road and Marshall Avenue at a public hearing during Monday’s board meeting.

The properties being discussed were Rael Automatic Sprinkler Co., located on the corner of Merrick Road and Marshall Avenue, and the house behind it at 11 Marshall Ave. Both owned by CND, LLC. If the rezoning and sub-division are granted by the Board of Architectural Review and Board of Zoning Appeals the properties would be sold to Max Condoleo, a Lynbrook resident who owns MC Body Works, Inc. in Valley Stream.

Condoleo was not present at the May 7 public hearing where residents who live on Marshall Avenue voiced their concerns about the type of business that would be moving into their area. The board adjourned the hearing until Monday in order to find out what the potential new property owner’s intentions were for the land.

“Right now I’m buying as an investment,” Condoleo told the board on Monday, “and then in the future see what I can do.”

Under the current zoning map, the home on Marshall Avenue is split between a residential and commercial property line. The existing line runs parallel to Merrick Road, while the home does not. The current owner of the properties asked to have the line redrawn in order to square off the home and make it solely a part of a residential zone. Condoleo said he would plan on keeping the house for his sister to move into.

The second part of the proposal would be to sub-divide the two properties to make them two separate parcels. The width, or frontage, of the residential lot would be cut from 50 feet to 37.5 feet in order to accommodate additional parking for the commercial property. Village code states that the amount of parking spaces a commercial property must have depends on the area of the building— this particular property requires 21 parking spaces.
