Psaty, of 28 Park Circle, Cedarhurst who works as a water proofer was sentenced by Queens District Attorney Richard A. Brown to six months in jail on May 1 after he pled guilty on April 4 to the a variety of charges including practicing medicine without a license and aggravated sexual assault. The charges stem from last November when Law enforcement officials said Psaty, 55, requested that an undercover police officer who posed as a job seeker, strip and submit to a pap smear swab before soliciting her to perform a sexual act on him. During the interview, detectives said Psaty requested the undercover agent to go into the bathroom and remove her clothes so that he could obtain a pap smear. The undercover officer made an excuse and left the motel room and later that day she again met with the defendant who offered her $25 to masturbate him.
Queens law enforcement officials pressed charges against the Cedarhurst resident saying that he posed as Dr. Richard Rubin, telephoned a Brooklyn employment agency and requested the agency to provide him with potential employees who were female and immigrants. The agency put him in touch with a 20-year-old Polish immigrant who earlier in the year had paid the agency a $100 fee to assist her in obtaining a job, according to detectives.
Psaty was charged by Brown with two felony complaints including two counts of Unlawful Practice of his medical profession, two counts of Unauthorized Use of a Professional Title, one count of Aggravated Sexual Abuse in the Fourth Degree, one count of Sexual Abuse in the Third Degree and one count of Patronizing a Prostitute in the Fourth Degree.
At the sentencing on May 2, Justice Pauline A. Mullings sentenced Psaty to six months in jail from time served and 10 years probation under the aggravated assault pleas along with a concurrent term of five years probation under the unlicensed practical pleas. Justice Mullings also indicated that if Psaty violates the terms of his probation within the first five years, he will be sentenced to 2 and 2/3 to 8 years. If a violation occurs after five years, he will be sentenced to 1 and 1/3 to 4 years in state prison.
