Alexander was indicted by a Grand Jury on June 28 on two counts of murder in the first degree, four counts of murder in the second degree, one count of kidnaping in the first degree and one count of attempted sexual abuse in the first degree.
Nassau County District Attorney Denis Dillon explained that the first degree murder counts stem from the Grand Jury's determination that Alexander intentionally killed Kolb while in the course of committing the crime of kidnaping in the first degree and attempting to commit the crime of sexual abuse in the first degree.
The four counts of second degree murder involved one count of intentional murder, one count of depraved indifference murder and two counts of felony murder, involving the kidnaping felony and the attempted sexual abuse felony.
A tearful Alexander pleaded not guilty to the charges at his Monday, July 2 arraignment
Police say the 23-year-old lured Kolb, an acquaintance, to the Hicksville Econo Lodge and stabbed him to death when Kolb rejected his sexual advances. To conceal the crime, police say Alexander drove the body around in his Land Rover for a week, transferred it to a storage facility and ultimately buried bags of body parts under his backyard barbecue.
Defense Attorney Eric Naiburg may pursue a psychiatric defense.
"No stone can be left unturned, we're talking a human life," he explained in a statement.
Nassau District Attorney Denis Dillon has 120 days to decide whether to pursue the death penalty. It would be the first time since the penalty was reinstated in New York in 1995 that the Nassau DA would seek that punishment.
