Suspect pleads not guilty to 1st-degree murder

During an appearance in Nassau County Court in Mineola on Sept. 14, Evan Marshall, 31, pleaded not guilty to the Aug. 17 murder of his Glen Cove neighbor, Denice Fox, a 57-year-old retired New York City special-education teacher. Marshall's court appearance came after the main charge against him was upped from second- to first-degree murder for allegedly intentionally killing Fox while committing another felony, which is breaking into her home.
Nassau County homicide detectives said Fox, who moved from Hewlett Harbor to Glen Cove in May, was the victim of an apparent "psycho-sexual murder." Fox was a resident of Baldwin Harbor for most of her life before she moved to Hewlett Harbor in the mid-1990s.
Marshall is accused of breaking into Fox's Willada Lane home in Glen Cove, confronting her and stabbing her with his knife and then using her kitchen knife to carve up her body, detectives said.
Detectives obtained a search warrant for Marshall's home, where he lived with his mother two doors away from Fox, and discovered the victim's body in the basement, along with mannequins and sadomasochistic paraphernalia, police said. Marshall was arrested the following day while he drove around Glen Cove with the victim's head in a gym bag in the trunk of his car, police said.
Marshall has been hit with a 13-count indictment including charges of second-degree murder, burglary and criminal possession of a weapon, for the knife prosecutors say he used to kill Fox. If convicted of first-degree murder, Marshall could receive life in prison without parole.
Marshall also was charged with first-degree assault for a hit-and-run against Cynthia Kouril, 48, of Glen Cove, that occurred about 30 minutes before the Aug. 17 killing, officials said.
