Long Beach woman indicted on charge of leaving the scene of a crime after bicyclist death

Nassau County District Attorney Anne Donnelly announced that a Long Beach woman has been indicted on a charge of leaving the scene of an incident without reporting resulting in death — a class D felony.

Erin Henry, 67, was arraigned on July 1, before Judge Robert Bogle in Nassau County Court, where she was charged in a hit-and-run crash that killed a bicyclist in Atlantic Beach in March. She pleaded not guilty.

Henry's bail was set at $25,000 cash, $50,000 bond or $125,000 partially secured bond. She is scheduled to return to court Aug. 11. If convicted, she could face up to seven years in prison.

According to prosecutors, the crash happened at about 7:45 a.m., March 24 on Beech Street in Atlantic Beach. Henry was driving a 2019 Honda HR-V eastbound when police say she struck 59-year-old Tony Thomas, who was riding a bicycle.

"This defendant allegedly struck an innocent man riding his bike, continued driving, and left him to die. Bystanders called emergency services, but tragically, it was too late for the victim, who suffered serious injuries and died at the scene,” DA Donnelly said. “Quick-thinking witnesses recorded Henry’s license plate, and she was located by police driving to work as if nothing had happened."

Police used witness information to identify the vehicle and stopped Henry a short time later at the intersection of West Park Avenue and Vermont Street in Long Beach. She was arrested shortly afterward.

The case is being handled by Assistant District Attorneys Brittany Battista and Alexandra Laird of the Vehicular Crimes Bureau. Henry is represented by attorney Steven B. Epstein.
